La Contraloría General de la República acusó a la Superintendencia del Medio Ambiente de no gestionar 2.508 denuncias recibidas entre el 1 de enero de 2016 y el 31 de mayo de 2019, lo que se traduce a un 44% de las demandas presentadas en la institución.
El informe señaló que no existe constancia de que institución haya fiscalizado o iniciado un procedimiento sancionatorio, y tampoco que se hayan amparado a alguna gerencia que establece la Ley Orgánica de la Superintendencia.
Cristóbal De La Maza, superintendente de Medio Ambiente, señaló que ante la situación será transparente y que recibía el informe con humildad. Declaró que desde su llegada -en octubre de 2019- ha hecho todas las gestiones para mejorar la atención de las demandas.
Pero la autoridad medioambiental agregó que era necesario que se inviertan más recursos para llevar a cabo de forma correcta la reestructuración de la SMA.
Bajo este contexto, el abogado y ex fiscal del Ministerio de Medio Ambiente, Jorge Andrés Cash, señaló que la Contraloría debería considerar los esfuerzos de mejoría por parte de la Superintendencia. Pero también, declaró que la falta de recursos no es una excusa.
Bajo el contexto, el director del Observatorio Latinoamericano de Conflictos Ambientales, Lucio Cuenca Berger, declaró que, desde su punto de vista, la situación era gravísima y que como consecuencia muchos casos ambientales empeoraron.
Actualmente, existen 16 mil denuncias que fueron presentadas a la Superintendencia de Medio Ambiente, de las cuales siete mil siguen en curso; tres mil tienen investigaciones con mayor avance; y otras tres mil no han -siquiera- iniciado su investigación.
