El máximo tribunal de la región ordena al SEA que debe considerar la participación ciudadana lo que fue negada en su momento pese a las más de 2.0000 firmas de vecinos que lo solicitaron en junio de 2019
El dia de ayer Miércoles la corte de apelaciones de Valparaíso falló a favor del recurso de protección presentado por distintos vecinos de la comuna de Putaendo y la agrupación Putaendo Resiste quiénes pedían dejar sin efecto la autorización para los sondajes que el SEA entregó en abril del presente año a Vizcachitas la aprobación para realizar nuevos 350 sondajes.
En un contundente fallo el tribunal acogió el recurso y anula la aprobación, por lo tanto, el proyecto minero Vizcachitas Holding tiene que volver atrás, hacer la participación ciudadana y hacer todo el proceso nuevamente.
El fallo en lo medular
Se acoge el recurso de protección deducido a folio 1, por el abogado don Álvaro Toro Vega, en representación de las personas que
indica; y, en consecuencia, se deja sin efecto la Resolución Exenta Nº 76 de 17 de marzo de 2020, del Servicio de Evaluación Ambiental,
Región de Valparaíso, que rechaza las solicitudes de efectuar un proceso de participación ciudadana, en la evaluación de la Declaración de Impacto Ambiental del proyecto Sondajes Mineros de
Prefactibilidad Las Tejas, retrotrayendose el proceso de Declaración de Impacto Ambiental al momento previo a su calificación , debiendo
someterse el proyecto, previamente, al procedimiento de participación ciudadana previsto en los artículos 26 a 31 de la Ley N 19.300 sobre Bases Generales del Medio Ambiente.
Lo anterior se traduce en los siguientes actos ordenados por la Corte de Apelaciones de Valparaíso,
