Fabián Muñoz en una segunda demanda pretendió una indemnización de mas de 70 millones de pesos a su favor lo que fue rechazado incluso por la Corte de Apelaciones y hoy debe pagar los 8 millones como costas de dicho juicio.

El tribunal laboral de la comuna de Putaendo condenó al ex administrador municipal Fabián Muñoz Díaz al pago de 8 millones de pesos correspondientes a las costas del juicio que se llevó adelante por despido injustificado, persecución y otros, y que la ex administración municipal interpuso contra la entidad edilicia y que perdiera definitivamente en la Corte de Apelaciones de Valparaíso.
La abogada del municipio de Putaendo y jefa del equipo jurídico Carolina Vergara, señaló a nuestro medio que fueron notificados de dicha sentencia y que esta se enmarca dentro de las normas jurídicas pues el tribunal entiende que el demandante no tuvo argumentos para presentar la demanda e iniciar el juicio y lo condena al pago de las costas de todo juicio, lo que en este caso asciende a los 8 millones de pesos, que deben ser pagados por Fabián Muñoz Díaz en favor de la municipalidad de Putaendo, dentro de los plazos y formas que el tribunal resuelva en las próximas audiencias.
La jurista dijo que el argumento presentado por la defensa de Muñoz Díaz era totalmente inválido, pues, en su argumentación, le señalaron al tribunal que no correspondía el pago de las costas pues estos dineros irían directamente como honorarios a su persona, es decir, para ella, donde Carolina Vergara, dijo que en este caso ella actuó como abogada municipal y no como abogada particular, razón por la cual esa indemnización va directamente a las arcas municipales y no a los abogados que de una u otra forma defendieron la demanda en el tribunal.
Vergara, dijo que si bien es cierto el sentenciado hoy puede incluso apelar o presentar un recurso a la Corte de Apelaciones, este fallo está dentro de la normativa legal y lo más importante viene a dejar con claridad absoluta que nunca existieron argumentos concretos para la demanda que se presentó por más de 70 millones contra el municipio, mientras que dijo que aún la Corte de Apelaciones no resuelve la primera demanda presentada por Fabián Muñoz contra el municipio de Putaendo por más de 20 millones de pesos la que se espera debe ser resuelta por la misma corte dentro de los próximos meses.
