Entre otros testigos también aparecen el actual presidente de la Unión Comunal de organizaciones sociales [UNCO] Rene Reyes.

Uno de los testigos que presentará el ex administrador municipal en sus demandas contra la Ilustre Municipalidad de Putaendo es la concejal del Partido Socialista Marta Silva, recientemente reelegida en su cargo y que contradictoriamente, tiene dentro de sus obligaciones cuidar y defender el patrimonio económico de todos los putaendinos.
Para nadie es un misterio que Marta Silva y Fabian Muñoz son buenos amigos, sin embargo, anteponer dicha relación de fraternidad y compañerismo político (ambos militan en el PS) a los intereses de la comunidad putaendina, es a lo menos inexplicable y éticamente reprochable.
Lo anterior porque nos hemos enterado recientemente, que la actual y reelecta concejala socialista, será uno de los testigos en el juicio por tutela laboral y despido injustificado que se ventilará en el tribunal de Letras de Putaendo.
Al respecto, para algunos puede ser un testigo más en un juicio cualquiera, pero estamos en presencia de una concejal en ejercicio, que testificará a favor de quien demanda por 100 millones de pesos a la municipalidad. El daño financiero y patrimonial, eventualmente afectará a todos los habitantes de la comuna, porque esos dineros podrían gastarse o invertirse en otras necesidades de la gente más vulnerable.
Contrariamente a la obligación de defender el patrimonio económico de Putaendo, todo indica que la concejala Silva está de acuerdo que se le paguen más de 100 millones de pesos a quien fuera funcionario de exclusiva confianza del ex alcalde Reyes, y quien no deja de sorprender por su afán de que aún se le considere como un funcionario del municipio, cuando ya hace 10 meses que fue desvinculado y no trabaja para dicha institución pública.
Es preciso recordar, por si a alguien pudiese tener amnesia, que Muñoz fue durante 6 años administrador y alcalde subrogante y que a diferencia de otros altos directivos de la administración anterior que, pusieron sus cargos a disposición del actual alcalde Zamora, él prefirió auto decretarse vacaciones y no presentar la renuncia cuando le fue solicita por escrito.
Pues bien, es a este mismo funcionario de confianza, que la concejala Marta Silva pretende defender, siendo su testigo estrella, en el juicio cuyos alegatos están previstos para el próximo 23 de julio del 2021.
Lo mínimo que se hubiese esperado de una autoridad que jura defender el patrimonio comunal, es que cuando se enfrenta en una situación de este tipo, se inhabilite, porque debiera anteponer el bien común por sobre el interés particular de un amigo, aun cuando algún magistrado finalmente falle a favor del demandante.
Actitudes como la que veremos en tribunales, solo ratifican por qué la gente se ha alejado cada vez más de los partidos políticos y de una práctica cada vez más reñida con la ética y la moral pública.

Para efectos de registro, se deja constancia que la presente audiencia se realiza bajo la modalidad de la plataforma virtual Zoom, con la presencia de las abogadas, por la parte demandante doña Paulina Fernández Vásquez, y por la parte demandada doña Carolina Vergara Moreno.

3°. – En la efectiva de todas las anteriores, la procedencia de las prestaciones e indemnizaciones que alega el actor en su demanda, monto de las mismas en el caso de ser efectivas. 4°. – Efectividad de existir a la fecha un vínculo contractual vigente entre las partes, y en su
caso, época de inicio y época de término.
5°. – Efectividad de haber sido el despido del actor injustificado al tenor de las normas legales invocadas.

5.- Oficio N° 656 de fecha 21 de agosto de 2020 dirigido al demandante de autos Fabián Muñoz Díaz con devolución de licencia médica electrónica informando que no será recepcionada como tampoco tramitada, ya que por Decreto Alcaldicio N° 979 de fecha 31 de julio de 2020 dicho cargo se encuentra vacante.

8.- Memorándum N° 79 emitido por el Departamento de Control de fecha 21 de julio de 2020, que evacúa informe solicitado por el alcalde, para efectos de proceder al pago de remuneraciones del demandante.

11.- Informe resumen presupuestario planilla suplementaria correspondiente al mes de julio del año 2020 que comprende comprobante de depósito a la cuenta corriente de la Municipalidad de Putaendo con el fin de hacer pago a las remuneraciones del demandante.
